Unless otherwise indicated on quote:
Delivery and Installation are extra. If included, these are quoted at regular business hours (weekends and after-hours extra). Client is responsible to unload the product at arrival to their facility. Time to unload a truck is 30 minutes and 12 hours for a container, any additional time required to unload will result in extra charges.
In case that the site is not ready to accept the shipment at time of delivery, the Client is responsible to coordinate and to cover any and all additional expenses related to ship the product to and from a temporary storage facility, unloadload and unload the product. When delivery is included, pricing is calculated based on delivery of all material in one shipment. If changes to delivery plan are required by Client, all additional costs caused by these changes will be paid by the Client.
Upon delivery of the product, Client is responsible for its secure and convenient storage and for any loss or damage that it may suffer. When Metalsistem Canada is installing, Client will provide onsite any necessary equipment to unload the product from containers, and to manipulate product for installation such as forklift, pump truck and scissor lift at no expense to the supplier.
When installation is included, pricing is calculated based on the uninterrupted installation of all material supplied by Metalsistem Canada. If changes to installation plan are required or caused by Client, all additional costs derived from these changes will be paid by the Client. Once approved by the Client within the time period of validity, this document becomes and constitutes the entire binding contract of purchase and sale between the parties and there are no collateral agreements, representations, warranties contained express or implied, statutory or otherwise, other than as contained herein.
Proper disposal of packaging material garbage is responsibility of the Client. Client is responsible to ensure existing floor (or/and structure) is (are) adequate to support the loaded system; and to apply for a Building Permit and to provide fire and safety systems as required by codes and regulations. Delivery times are estimated but cannot be guaranteed. Metalsistem Canada will not be liable for any delay in the delivery caused by any conditions beyond Metalsistem Canada’s control. Stock availability can’t be guaranteed beyond date of quote.
Returns of customized product are not acceptable and returns of standard product will only be accepted at Metalsistem Canada’s sole discretion. There will be a 15% restocking fee for any returns in good state standard product.
The laws of the province of Ontario shall govern this contract.
Title to all goods is to remain in Metalsistem Canada’s possession unit the full purchase price is paid. If layouts and details are supplied by Metalsistem Canada, these must be signed and approval by the Client and sent back with the P.O. Before new orders are processed, all outstanding balances must be paid in full according to respective payment terms.
